Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Traffic Magnet (the “Service”) operated by Traffic Magnet (ABN 79 370 624 476) (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By creating an account or using any part of the Service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Description of Service
Traffic Magnet is a subscription-based SEO monitoring platform for small business owners. The Service includes:
- Keyword rank tracking — monitoring your Google search position for chosen keywords
- Google Search Console dashboard — a clear view of your site's search performance using data from your connected GSC account
- Automated site audit — scanning your website for common SEO issues with plain-English recommendations
- Weekly email digest — a Monday morning summary of keyword movements and one suggested action
We reserve the right to modify, suspend or discontinue any part of the Service at any time with reasonable notice.
3. Subscription, Billing and Cancellation
Free trial
New accounts include a 30-day free trial. A valid credit card is required to begin the trial. You will not be charged until the trial period ends. If you cancel before the trial ends, you will not be charged.
Billing
After the trial period, subscriptions are billed monthly in advance in Australian dollars (AUD), inclusive of GST. Your billing date is set on the day your trial ends and recurs on the same date each month.
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain full access until then. We do not offer refunds for partial months or unused portions of a billing period.
Price changes
We reserve the right to change subscription pricing. We will give you at least 30 days' notice of any price increase before it takes effect on your account. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Failed payments
If a payment fails, we will attempt to contact you and retry the charge. Access to the Service may be suspended if payment cannot be collected after reasonable attempts.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that violates applicable Australian or international laws or regulations
- Attempt to gain unauthorised access to any part of the Service, its servers, or connected systems
- Use automated tools (bots, scrapers or crawlers) to extract data from the Service beyond what is provided through the official interface or API
- Share, sell or transfer your account credentials to any third party
- Resell, sublicense or otherwise commercialise the Service or its outputs without our prior written consent
- Use the Service to collect or process personal data about third parties without appropriate authority
- Introduce viruses, malicious code or other harmful material into the Service or its infrastructure
We reserve the right to suspend or terminate accounts found to be in breach of this section.
5. Your Content and Data
You retain full ownership of all data and content you provide to the Service, including domain names, keywords and any connected Google Search Console data. By using the Service, you grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the Service to you.
We will not use your data for any purpose other than operating and improving the Service, and we will not disclose it to third parties except as described in our Privacy Policy.
6. Intellectual Property
All content, software, features and functionality of the Service — including but not limited to the interface design, brand assets, algorithms and documentation — are owned by Traffic Magnet and protected by Australian and international intellectual property laws. Nothing in these Terms grants you any rights in the Service other than the limited right to use it as described.
7. Disclaimer and Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by Australian law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
In particular, we do not warrant that:
- The Service will be uninterrupted, error-free or completely secure at all times
- Keyword ranking data, GSC metrics or site audit results are accurate, complete or up to date at any given time
- Use of the Service will result in improved search engine rankings or any specific business outcome
To the maximum extent permitted by law, Traffic Magnet's total aggregate liability to you for any claim arising out of or relating to your use of the Service will not exceed the total subscription fees you have paid us in the three months preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill or business interruption, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law that cannot be excluded by agreement.
8. Termination
You may terminate your account at any time from your account settings or by contacting us. We may suspend or terminate your account immediately if you breach these Terms, fail to pay subscription fees, or if we are required to do so by law.
Upon termination, your right to access the Service ceases immediately. Sections that by their nature should survive termination will do so, including Sections 5, 6, 7, 9 and 10.
9. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from these Terms or your use of the Service.
Nothing in these Terms limits any non-excludable rights you may have under the Australian Consumer Law or other applicable Australian legislation.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service at least 14 days before the changes take effect. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
